1. Subscription Overview

1.1 Subscription Agreement

By purchasing a subscription, you agree to the terms and conditions outlined below. The subscription provides access to specific services/benefits as described at the time of purchase.

1.2 Subscription Period

• The subscription is valid for a fixed term, 1st February – 31st January.

• Subscription renewal, if applicable, must be completed before the expiry date to maintain continuous access to benefits.

2. Fees, Payments & Refund Policy

2.1 Payment Terms

• The subscription fee is payable in advance and must be paid in full before benefits are granted.

• Payment can be made via the accepted methods specified at checkout.

2.2 Cooling-Off Period

• Subscribers have 14 days from the date of payment to request a refund or modification to their subscription.

• After this period, subscriptions are non-refundable and non-transferable under any circumstances.

2.3 Non-Refundable Conditions

Once the cooling-off period has passed, refunds or partial refunds will not be provided in cases including, but not limited to:

• A subscriber choosing not to use their benefits.

• Cancellation or postponement of events/services associated with the subscription.

• Suspension or termination of the subscription due to a breach of the terms of service.

3. Access, Benefits & Trader Responsibilities

3.1 Market Access & Selection

• Subscriptions do not guarantee market access or access to services. Trader selection remains subject to availability, suitability, and NNCG’s selection criteria, which may be influenced by third-party partners for certain events.

• Traders may express interest in any market within their subscription tier and category but must adhere to the application and selection process.

3.2 Service Availability

• The subscription grants access to specific benefits as outlined at the time of purchase, including the opportunity to express interest in certain events, services, or opportunities.

• Participation in events or services is subject to availability and selection criteria and trader categories where applicable. A subscription does not guarantee a place unless explicitly stated otherwise.

• Access to opportunities such as trading at markets always requires the completion of an Expression of Interest (EOI) form. Submission of an EOI does not guarantee acceptance, as participation is subject to eligibility criteria, availability, and market suitability.

• Subscribers with selected priority access options are guaranteed selection, provided they complete the expression of interest before the closing date.

• Participation in trading opportunities is also subject to the trader maintaining all required documentation, including but not limited to valid insurance, Environmental Health registration, and any other safety certifications as required.

3.3 Modification of Benefits

• NNCG reserves the right to modify, add, or remove benefits as necessary. Any changes will be communicated in advance.

• If significant changes occur, NNCG may offer alternative options to affected subscribers but is not obligated to provide refunds.

3.4 Trader Responsibilities

• All traders must adhere to NNCG’s market policies, including health and safety requirements, trading standards, and ethical guidelines.

• Any breach of conduct may result in suspension or termination of the subscription without refund.

4. Risk & Cancellation Clause

4.1 Assumption of Risk

• Subscribers acknowledge that participation in any services, events, or activities included in the subscription carries inherent risks, including but not limited to event cancellations, unforeseen changes, or external disruptions.

• NNCG is not liable for any losses incurred due to these circumstances.

4.2 Force Majeure

• NNCG will not be held responsible for failure to deliver services due to events beyond reasonable control, including but not limited to:

  • Adverse weather conditions.

  • Venue closures.

  • Government restrictions.

  • Supplier disruptions.

4.3 No Compensation for Cancellations

• In the event of cancellations NNCG is not required to provide refunds or compensation against the annual subscription fee.

• The subscription fee helps cover the administrative costs of managing registrations, admin, priorities, expressions of Interest applications, and handling trader selection.

• As these services are provided from the time of purchase and actively managed up until the point of cancellation, subscription fees remain non-refundable and non-transferable, even if a market/activity/event is cancelled. This includes packages where priority market selections are selected as part of the overall subscription package.

• Trading Fee Refunds are subject to our usual refund policy which is available on your EOI and  invoice and is fully refundable in the event of a cancellation.

 

5. Account Suspension & Termination

5.1 Code of Conduct

• Subscribers must adhere to any relevant trading policies, rules, or ethical guidelines set by NNCG.

• Failure to comply may result in suspension or termination of the subscription without refund.

5.2 Provider’s Right to Terminate

• NNCG reserves the right to terminate a subscription at its discretion if a subscriber:

  • Violates the terms of service or trading terms and conditions.

  • Engages in fraudulent or inappropriate behaviour.

  • Misuses benefits or services.

6. Data Protection & Privacy

6.1 Use of Personal Information

• Subscriber data will be collected, stored, and processed in accordance with applicable data protection laws.

• By subscribing, you consent to the publication of the details you provide for inclusion in the Makers Directory. This may include:

  • Business name.

  • Contact details.

  • Product descriptions.

  • Any other relevant information you submit in future for public listing.

• If you do not wish for certain details to be published, you must inform NNCG in writing at the time of subscription.

• Information will not be shared with third parties without consent, except:

  • As required by law.

  • Where necessary to fulfil operational, legal, or compliance obligations in relation to events, partnerships, venue requirements, or safeguarding responsibilities.

7. Amendments & Changes to Terms

7.1 Right to Modify Terms

• NNCG reserves the right to amend these terms at any time.

• Subscribers will be notified of any significant changes that may affect their benefits or obligations.

7.2 Dispute Resolution

• Any disputes arising from the subscription will be handled in accordance with the NI governing law applicable to NNCG.

 

8. Liability & Indemnification

8.1 Limitation of Liability

• NNCG is not liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of, or inability to use, the benefits associated with the subscription.

• NNCG’s total liability for any claim related to the subscription shall not exceed the amount paid by the subscriber for the current subscription period.

8.2 Indemnification

• By subscribing, you agree to indemnify and hold NNCG harmless from any claims, damages, liabilities, or expenses (including legal fees) arising from:

  • Your breach of these terms.

  • Any violation of applicable laws, regulations, or third-party rights.
